A three-member bench of the Supreme Court, headed by Justice Sardar Tariq Masood, heard the petition against the decision of the Peshawar High Court, which was written by Justice Muhammad Ali Mazhar.

According to the decision of the family court, the woman was ordered to terminate the marriage on the basis of mental cruelty and violence, while the husband was also ordered to bear the non-maintenance and monthly expenses of the daughter.

The Peshawar High Court cancelled the decision of the Family Court and ordered the marriage to be terminated in the manner of Khula, and also ordered the woman to pay 5 tolas of gold to her husband during the process of Khula. 

The Supreme Court appealed to the petitioner. Following the implementation of the case in which the Supreme Court annulled/cancelled the decision of the Peshawar High Court and restored the decision of the Family Court and it was decided in favor of the woman.
